「公民不服從」與「良心拒絕」的定義
第二週上課的提綱與討論
一、羅爾斯對「公民不服從」(Civil Disobedience)的定義：
I shall begin by defining civil disobedience as a public, nonviolent, conscientious yet political act contrary to law usually done with the aim of bringing about a change in the law or policies of the government. (1999: 320)
一種公開的、非暴力的、既是按照良心的，又是政治性地對抗法律的行為，其目的通常是為了使政府的法律或政策產生改變。
二、羅爾斯對「良心拒絕」(Conscientious Refusal)的定義：
Conscientious refusal is noncompliance with a more or less direct legal injunction or administrative order. It is refusal since an order is addressed to us and, given the nature of the situation, whether we accede to it is known to the authorities.
三、僅適用a nearly just society。
This civil disobedience theory is designed only for the special case of a nearly just society.
關於「合法性」問題的釋疑。
In this range of possibilities it stands for that form of dissent at the boundary of fidelity to law.

四、對位式地思考。
在《文化與帝國主義》書中，薩依德陳述兩種思考形態：一為直線規約的，一為對位遊牧的，他並推崇第二種思考模式，是為理解人類歷史的較好角度（1994:xxv）。

五、今天第二堂課的「318學運討論」。
1.如果說，「1960年代」是認識當今世界的關鍵十年；那麼，「2014年318學運」（318-410）是認識當今台灣的關鍵一年。

2.學生運動的特殊「純粹性」。
巴西教育家弗雷勒(P. Freire)在《受壓迫者教育學》書中指出，當今社會仍是相當威權的，整個教育體系是為「壓迫者」服務，而學生的處境就是「受壓迫者」的具體而微。透過「覺醒」，開展出整個對話的行動理論。弗雷勒那一段關於學生角色的特殊獨特，在書的145頁注釋裡這麼寫著：
「也就是這樣，壓迫者必須將農民與城市勞工分開，正如壓迫者也必須將農民勞工與學生分開。雖然學生在社會理論上並不是一個階級，但跡象證明，當學生也起身加入社會大眾反抗後，就會讓壓迫者感到情勢危急。」

For this reason it is indispensable for the oppressors to keep the peasants isolated from the urban workers, just as it is indispensable to keep both groups isolated from the students. The testimony of rebellion of the latter (although they do not sociologically constitute a class) makes them dangerous.
